O ministro Edson Fachin, do STF (Supremo Tribunal Federal), anulou hoje todas as condenações do ex-presidente Luiz Inácio Lula da Silva pela Justiça Federal do Paraná no âmbito da Operação Lava Jato. Com a decisão, Lula volta a ser elegível, podendo disputar as eleições de 2022 se assim o quiser.
Ao conceder o habeas corpus a Lula, Fachin declarou que a 13ª Vara Federal de Curitiba, origem da Lava Jato, não tem competência para julgar os processos do tríplex do Guarujá (SP), do sítio de Atibaia (SP) e do Instituto Lula.
A decisão, porém, não tem relação com as acusações de que o ex-juiz Sergio Moro tenha sido parcial na condução dos processos, como alega a defesa de Lula. Fachin não concorda com este entendimento, e o caso está sendo julgado pela Segunda Turma do STF.
Em nota, o gabinete de Fachin explicou que, embora a questão da competência de Curitiba para analisar os processos de Lula já tenha sido levantada anteriormente, “é a primeira vez que o argumento reúne condições processuais de ser examinado, diante do aprofundamento e aperfeiçoamento da matéria pelo Supremo”.
