Os servidores concursados da Prefeitura Municipal de Nova Xavantina Dr. Celso Bicudo Jr., Assessor Jurídico, e Josimar Pires da Silva, Contador, desmentiram na tarde desta quarta feira, 16, matéria veiculada por um site do municipio no último dia 05, segunda a qual, a Prefeitura, na gestão do ex-prefeito João Batista Vaz da Silva, o Cebola, teria contratado irregularmente a empresa de advogados Hidasi e Aires Sociedades de Advogados, com sede no Piauí.
CUMPRINDO A LEI
Dr. Celso explicou que a inexigibilidade do processo de licitação para o caso deve-se ao cumprimento da lei das licitações, que prevê a dispensa do certame quando a demanda carecer de “notória especialização profissional”, o que ficou patente segundo o Assessor pelos documentos apresentados, já que os serviços a serem executados requeriam este notócio saber na área, pois tratava-se da recuperação do ISS devido pela rede bancária à Prefeitura, o que exige especialização na área tributária, pois os impostos são cobrados pelo faturamento que as agências declaram.
Conforme o contrato de prestação de serviços nº 033/2017 celebrado entre a Prefeitura e a empresa advocatícia, sua modalidade era de risco, ou seja, do total de quase Rr$ 12 milhões de débitos bancários projetados para serem recuperados, a empresa teria 15% de comissão.
NÃO ENTROU
Como não houve nenhuma recuperação, e nenhum pagamento do referido débito, ou seja, não houve a entrada das receitas projetadas, não houveram pagamentos, e o contrato foi rescindido, sem nenhum ônus para o município.
Ou seja, sem recebimento não houve pagamento, e a execução do objeto do contrato simplesmente não aconteceu.
